License agreement

The below lists the License Agreement to which users of Webuzo must agree before using the Webuzo package:

• This license applies to FREE / PREMIUM / PAID Webuzo packages.
• Licensee and/or their Enduser(s) may use this software for both personal and commercial purposes.
• You may NOT modify our Webuzo code in any way; however you may modify themes or languages based on your needs.
• PREMIUM / PAID license includes free support and regular updates and expires on the date of expiry (GMT timezone). To continue receiving support and regular updates, the Licensee will need to renew the license at the prices set by Webuzo. Prices can be found on the pricing page.
• Lifetime license includes 1 year of support and updates from the date of activation (creation of the first user account). Licensee can renew update and/or support for their Lifetime license(s) at the prices set by Webuzo.
• A Lifetime license is valid till the life of the server / node hardware and cannot be used on another server / node. The license dies with the server hardware. In the event you sell the hardware, the license will also be transferred to the new owner. For the purpose of the Lifetime license, the life of the hardware is considered the life of the motherboard of the server. If the motherboard is replaced or becomes non-functional, the Lifetime Webuzo license will be considered to have rendered useless.
• Licensee and/or their Enduser(s) may NOT redistribute or repost/resell for download any part of this software (Webuzo package) without expressed written consent from the Webuzo team. Redistribution includes re-offering our software for download in any fashion, whether on a competing website, an application that generates code snippets, or a CD-ROM collection of PHP codes, etc.
• Licensee and/or their Enduser(s) agree not to remove/edit the credit notice within the source code, or claim the code to be work of their own.
• Licensee and/or their Enduser(s) agree not to use this software for illegal purposes, or on sites containing illegal material.
• Licensee and/or their Enduser(s) agree not to hold https://webuzo.com/ (Webuzo) or any other parties liable for any damages that may result from use or misuse of this software.
• Licensee and/or their Enduser(s) agree not to remove, hide, or modify the copyright notice at the bottom of the pages of the software (Webuzo package).
• Breach of this license may result in immediate cancellation of your license(s), and no refunds will be given.
• The pricing structure may be changed at any time. Price changes do not affect existing licenses. The new rates will be applicable to the existing licenses when the license is renewed.
• Enduser(s) / clients of the Licensee who will use the Webuzo Enduser Panel, please read and agree to the End User License Agreement.
• NO WARRANTY: There is no warranty for the software. The software is provided “AS IS” without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the software is with you.

Terms of service / license agreement (additional terms)

These Terms of Service (“Terms”) govern the relationship between you (“Enduser(s)”) and Electron Technologies FZC. Each Enduser is subject to these Terms, and by using Webuzo’s services, network and/or systems (collectively the “Services”), Enduser agrees to be bound by the usage policies and other policies contained in these Terms.

Enduser represents and warrants that, if an individual, Enduser is at least 18 years old, or, if an entity, Enduser is a corporation, limited liability company, partnership, or other legal entity duly formed and in good standing where required to do business with all legal authority and power to accept these Terms.

Webuzo reserves the right, in its sole discretion, to change, modify, add or remove all or any part of these Terms at any time with or without notice. Endusers may view the most current version of these Terms on webuzo.com. Continued use after changes constitutes acceptance. If you do not agree, your sole remedy is to cancel your account / stop using the Services.

Term, payment, account renewal

• Term of service. The term of Enduser’s subscription to the Services commences upon Enduser’s acceptance of these Terms and terminates as set forth in this agreement.
• Payment. Enduser agrees to pay all fees for Services upon upgrading to premium version of Webuzo or upon renewal. Webuzo may be made available for free by many partners, in which case the enduser does not pay Webuzo directly.
• Authority. Where Enduser is a business entity or group, the person registering or renewing warrants authority to bind that entity.

Cancellation of services, refund policy

• Cancellations. The Enduser may cancel their account/license at any time from the Client Center.
• Refunds — annual license: within one month of purchase via billing@webuzo.com.
• Refunds — one-month license: within 15 days of purchase via billing@webuzo.com.
• Refunds — lifetime (“owned” / one-time) license: within one month of purchase via billing@webuzo.com.

Proprietary rights

These Terms do not give Enduser any rights to Webuzo intellectual property or technology. Webuzo and related trademarks and logos are the exclusive property of Webuzo.

Security

Webuzo uses sophisticated means of security in connection with the Services. Webuzo will not be liable for any loss or damages of any kind, under any legal theory, arising from security-related incidents beyond its reasonable control as further limited below.

Privacy & cookies

Please read our Privacy Policy. Webuzo uses cookies to improve our website and web services and, for existing Endusers, for convenience (for example remembering a username—not passwords). Cookies may also inform us of a repeat visit without identifying who you are by name.

General policies

• Monitoring and disclosures. Activities may be monitored, recorded, and examined by authorized persons, including law enforcement, where lawful. In general Webuzo does not monitor Endusers’ websites or activity except as needed for abuse, security, or legal compliance.
• Reservation of rights. Webuzo reserves the right to refuse and cancel service to any Enduser for any lawful reason at any time during the Term of Service.
• Copyrights and script licensing. When a customer uses an application provided by Webuzo / Softaculous, the customer licenses it from the organization that developed the application, not from Webuzo.
• Script library support. Webuzo cannot guarantee that every packaged version is always the absolute latest upstream release, but always tries to offer the latest stable version.
• Post-process support. Webuzo does not provide support for the application once successfully installed; support covers installation, upgrade, backup, or clone tooling of the installer.
• Data loss. Due to the automated nature of the Services and possibility of data corruption and loss, use of the Services is at your own risk. Keep your own backups.

Warranty disclaimer — limitations — indemnification

Warranty disclaimer. YOU ACKNOWLEDGE THAT THE SERVICES AND THE SOFTWARE ARE PROVIDED “AS IS, AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND. WEBUZO DISCLAIMS ANY WARRANTY OR CONDITION WITH RESPECT TO THE SERVICES OR SOFTWARE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

Limitations on Webuzo’s liability. WEBUZO SHALL NOT BE LIABLE FOR NONPERFORMANCE OR DELAY IN PERFORMANCE CAUSED BY ANY REASON, WHETHER WITHIN OR OUTSIDE OF ITS CONTROL. IN NO EVENT SHALL WEBUZO BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Indemnification. You agree to defend, indemnify and hold Webuzo, its affiliates and its sponsors, partners or other co-branders and their respective officers and employees harmless from and against any claims arising from your use of the Services or violation of these Terms.

IF YOU DO NOT AGREE TO ANY OF THE FOREGOING TERMS, YOU MUST DISCONTINUE THE REGISTRATION PROCESS, DISCONTINUE YOUR USE OF THE SERVICES, AND, IF YOU ARE ALREADY A MEMBER, CANCEL YOUR ACCOUNT.
